Privacy Policy
This Privacy Policy explains how Vivsivo LLC d/b/a "Elevate Digital" ("Elevate Digital," "we," "us") collects, uses, and shares personal information through elevateyourdigital.org and our services. Cloud infrastructure used to provide our services is operated by our affiliate ZenLPCC LLC.
1. Scope
This policy covers personal information we handle as a business/controller — i.e., about our website visitors, prospects, and clients. When we process personal information about our clients' end-customers to deliver AI/automation features, we act as a service provider/processor on the client's behalf, and the client's privacy policy and our Data Processing Addendum govern that processing.
2. Information we collect
- You give us: name, business name, email, phone, and intake answers when you contact us, request a quote, or sign up.
- Clients/leads: business + contact information; for clients on AI tiers, information needed to configure services.
- Automatically: device/usage data, IP address, and cookie data when you use the site (see our Cookie Policy).
- From third parties: publicly available business listing data we use for outreach (e.g., via Google Places).
We do not seek sensitive/special-category data through the website and ask that you not submit it.
3. How we use information
To: provide, operate, and improve the services and website; respond to inquiries and provide support; process billing and payments; send service and (with any required consent) marketing communications; ensure security and prevent fraud; and comply with law. We do not sell your personal information, and we do not "share" it for cross-context behavioral advertising as those terms are defined under California law.
4. How we share information
We share personal information with service providers/sub-processors under contract, including: ZenLPCC LLC (infrastructure), Netlify (hosting), Supabase (database), Anthropic/Claude (AI), Resend (email), Twilio (voice/SMS), ElevenLabs (AI voice), Google (Places/lead discovery), Stripe (payments), and Higgsfield (ad creatives). We may also share to comply with law, enforce agreements, or in a business transfer.
5. Marketing communications & messaging
We send marketing emails only with the appropriate basis and include an unsubscribe link (CAN-SPAM). If you receive SMS or calls from one of our clients' systems, those are sent by the client as sender of record; opt out by replying STOP or contacting that business. 6. Cookies
We use cookies and similar technologies as described in our Cookie Policy, including a consent mechanism where required.
7. Data retention
We keep personal information only as long as needed for the purposes above and as required by law:
- Prospect/intake data — 24 months from last contact.
- Client account/contract/billing records — term plus up to 7 years (tax/legal).
- E-signature/agreement audit trail — term plus 7 years.
- End-customer SMS/voice transcripts (processed for clients) — 90 days default, then purged.
- Server/access logs — 30–90 days.
8. Your rights
Depending on where you live, you may have rights to access, correct, delete, or port your personal information, to opt out of sale/sharing or targeted advertising, and to limit use of sensitive information (California CCPA/CPRA), or rights of access, rectification, erasure, restriction, objection, and portability and to lodge a complaint with a supervisory authority (EU/UK GDPR). We do not discriminate against you for exercising these rights. To exercise rights, contact support@elevateyourdigital.org; we will verify your request as required by law. You may use an authorized agent where permitted.
9. GDPR legal bases (if applicable)
Where the GDPR applies, we rely on: performance of a contract (to provide services), legitimate interests (to operate/secure/market our business, balanced against your rights), consent (e.g., certain marketing/cookies), and legal obligation. You may withdraw consent at any time.
10. International transfers
We are based in the United States and process data in the US. Where we transfer data from the EEA/UK, we use an appropriate safeguard (e.g., Standard Contractual Clauses).
11. Children
The site and services are for businesses and are not directed to children under 13 (or under 16 in the EU). We do not knowingly collect children's data.
12. Security
We use reasonable technical and organizational measures to protect personal information but cannot guarantee absolute security.
13. Changes
We may update this policy and will post the new "Last updated" date; material changes will be communicated as required.
