Terms of Service
These Terms of Service ("Terms") govern your use of elevateyourdigital.org and the marketing/intake features on it (the "Site"), operated by Vivsivo LLC d/b/a "Elevate Digital" ("Elevate Digital," "we," "us"). If you purchase services, those are governed by our Master Services Agreement and the applicable Order Form and Addenda, which control over these Terms for paid services.
1. Eligibility & acceptance
You must be 18+ and authorized to act for any business you represent. By using the Site or submitting information, you agree to these Terms and our Privacy Policy and Cookie Policy.
2. The Site & accounts
The Site provides information about our services and lets you contact us, request quotes, and begin onboarding. You agree to provide accurate information and to keep any credentials secure.
3. Services, pricing & auto-renewal (summary)
Our services are sold on a subscription basis (one-time setup + recurring monthly fee, or annual prepay). Subscriptions renew automatically and continue until cancelled with 30 days' written notice, as detailed in the Subscription & Billing Terms. Setup fees are non-refundable. Pricing shown on the Site is subject to confirmation on your Order Form.
4. Electronic signatures & communications (ESIGN/UETA)
You consent to transact and receive communications electronically. Where you sign an agreement electronically (e.g., by typing your name and submitting our signing page), that constitutes your electronic signature under the ESIGN Act and Texas UETA, with the same effect as a handwritten signature. You may request a paper copy and withdraw consent for future electronic records by contacting support@elevateyourdigital.org.
5. Acceptable use
You will not misuse the Site: no unlawful, infringing, deceptive, or harmful activity; no malware, scraping that burdens our systems, or attempts to breach security; no use that violates the rights of others. We may suspend access for violations.
6. Intellectual property
The Site, our brand, content, templates, and software are owned by us or our licensors and are licensed, not sold (see MSA §5 for paid deliverables). You may not copy, modify, or redistribute our materials except as permitted.
7. AI features & no professional advice
The Site and our services may use AI-assisted content and chat. AI output may be inaccurate and is not professional, legal, medical, or financial advice. Do not rely on it for important decisions without independent verification.
8. No guarantee of results
We help businesses attract and manage customers but do not guarantee any specific result, lead volume, ranking, or revenue. Any examples are illustrative, not promises.
9. Third-party links & services
The Site and services integrate or link to third-party platforms (e.g., Stripe, Google, Twilio). We are not responsible for third-party content, services, or outages.
10. Disclaimers
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM IMPLIED WARRANTIES (MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT) AND DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS/DATA, ARISING FROM YOUR USE OF THE SITE. FOR PAID SERVICES, OUR LIABILITY IS LIMITED AS STATED IN THE MSA. FOR FREE USE OF THE SITE, OUR AGGREGATE LIABILITY WILL NOT EXCEED USD $100.
12. Indemnification
You will indemnify us against claims arising from your misuse of the Site or violation of these Terms or applicable law.
13. Governing law & disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Venue lies in the state and federal courts located in Collin County, Texas, unless an agreed arbitration clause applies.
14. Changes
We may update these Terms and will post the new "Last updated" date. Continued use after changes constitutes acceptance.
